§1 General provisions
- These Terms of Service set out the rules for the provision of services electronically and at a distance by Tomasz Iwanowski, operating a sole proprietorship under the business name The Cloudest Tomasz Iwanowski (“Service Provider”).

- These Terms apply to both consumers and businesses using the Service Provider’s services, unless a specific provision states otherwise.
- The Service Provider can be contacted via contact@tomasziwanowski.com, the form at tomasziwanowski.com/en/contact/, or the details in section 2.
§2 Definitions
- Service Provider – Tomasz Iwanowski, operating under the business name The Cloudest Tomasz Iwanowski.
- Client – a natural person, legal entity, or organizational unit without legal personality using the Service Provider’s services.
- Consumer – a Client who is a natural person entering into a legal transaction with the Service Provider not directly related to their business or professional activity.
- Services – services provided by the Service Provider, in particular design and development of websites, web applications, and consulting/audits regarding AWS cloud infrastructure.
- Agreement – a service agreement concluded between the Service Provider and the Client, including a distance contract within the meaning of the Polish Consumer Rights Act of 30 May 2014.
- Website – the site available at tomasziwanowski.com.
§3 Type and scope of services
- The Service Provider offers:
- design and implementation of websites (landing pages, multi-page business websites),
- design and implementation of web applications,
- consulting and audits of AWS cloud architecture, security, and costs,
- related services agreed individually with the Client (e.g. CI/CD implementation, Infrastructure as Code).
- The current scope and indicative prices are available at tomasziwanowski.com/en/offer/. Prices are indicative net rates (B2B) – the final quote is agreed individually based on project scope.
- An initial consultation regarding project scope is free of charge and does not constitute conclusion of an Agreement.
§4 Conclusion of the agreement
- The Agreement is concluded after a consultation, presentation of a quote by the Service Provider, and its acceptance by the Client (including by email).
- The Agreement may be concluded electronically (email correspondence, offer acceptance) or in writing, depending on the parties’ arrangements.
- Commencement of the Service may be conditional on payment of a deposit, the amount and payment date of which are agreed individually and stated in the quote/offer.
§5 Prices and payment
- Remuneration for Services is determined individually and stated in the quote provided to the Client before work begins.
- Settlements are made on a B2B basis – the Service Provider issues a VAT invoice.
- The standard payment model includes a deposit to start the work and a final payment upon delivery; for multi-stage projects, payment may be split into stages as agreed by the parties.
- Payments are made by bank transfer to the account indicated on the invoice, within the deadline stated on the invoice.
§6 Service delivery
- Delivery timelines for individual Services are indicative and stated in the quote – their length depends on project scope and complexity.
- The Client is required to cooperate with the Service Provider to the extent necessary for proper delivery, including timely provision of materials, content, and feedback.
- Delays in providing materials or approvals by the Client may extend the delivery timeline.
- The Service price includes one round of revisions, unless the quote states otherwise. Additional changes beyond the originally agreed scope are quoted separately.
§7 Rights and obligations of the parties
- The Service Provider undertakes to perform the Service with due diligence, in accordance with the agreed scope and current technical knowledge.
- The Client is required to use the Services in accordance with their purpose and not to provide unlawful content.
- The Service Provider reserves the right to refuse to perform a Service if its subject matter would violate applicable law or good practice.
§8 Liability
- The Service Provider is liable for non-performance or improper performance of the Service on general terms under the Polish Civil Code.
- The Service Provider is not liable for damages resulting from the Client’s improper use of the Service’s deliverables, or from actions of third parties (e.g. hosting or domain providers, external services beyond the Service Provider’s control).
- The Service Provider’s liability towards Clients who are not Consumers is limited to the amount of remuneration received for the given Service, unless the damage was caused intentionally.
§9 Complaints
- The Client has the right to file a complaint regarding a delivered Service.
- Complaints should be submitted electronically to contact@tomasziwanowski.com, with a description of the issue and contact details.
- The Service Provider will review the complaint and respond within 14 calendar days of receipt.
- If a complaint is upheld, the Service Provider will take corrective action agreed with the Client (e.g. corrections, adjustment of the deliverable).
§10 Right of withdrawal (applies to Consumers)
- A Consumer who has concluded a distance Agreement may withdraw from it without giving a reason within 14 days of its conclusion, by submitting a statement to the Service Provider (e.g. by email to contact@tomasziwanowski.com).
- If, at the Consumer’s express request, performance of the Service is to begin before the withdrawal period expires, the Consumer will be informed that once the Service Provider has fully performed the Service, the right of withdrawal will be lost.
- If the Consumer withdraws before the Service is fully performed, the Consumer is required to pay for services performed up to the moment of withdrawal, proportional to the scope of work completed.
- The right of withdrawal described in this section does not apply to Clients who are not Consumers, nor to natural persons concluding an Agreement directly related to their business activity where the Agreement is of a professional nature for them.
§11 Personal data
Rules for processing Clients’ personal data are described in the Privacy Policy available at tomasziwanowski.com/en/privacy/.
§12 Final provisions
- Matters not regulated by these Terms are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.
- The Service Provider reserves the right to amend these Terms for important reasons (e.g. changes in law, changes to the scope of services). Amendments do not affect Agreements concluded before they take effect.
- Any disputes will be resolved amicably, and failing agreement, by the court having jurisdiction over the Service Provider’s registered address, subject to mandatory provisions on jurisdiction in consumer matters.
- Consumers may use out-of-court methods of handling complaints and pursuing claims, including via the EU ODR platform: ec.europa.eu/consumers/odr.
- These Terms are effective as of 03.08.2026.
